SOBRE EL NUEVO CONCEPTO DE SERVICIO PÚBLICO EN EUROPA

Resumen

Los servicios públicos, en un inicio, mantenían una concepción intrínsecamente estatal. Es por eso, que los postulados de grandes pensadores como Dugüit y la Escuela de Burdeos que atribuían únicamente al Estado la posibilidad de prestarlos o de disponer de ellos a su voluntad para alcanzar los fines sociales del mismo. Sin embargo, este concepto implicó varias irregularidades y no pudo mantenerse consistente debido a falencias presentes en su naturaleza conceptual y la contraposición ante una realidad globalizada, plagada de intereses económicos, políticos, geográficos, etc. Ante esto, muchos países han buscado una solución para poder prestar servicios públicos de una manera sustentable y, a la vez, alcanzar todos los fines sociales sin perjudicar a los ciudadanos ni dejarlos a merced del sector privado. Entre todos los Estados, ya sea de manera individual o colectiva las soluciones no parecían dar resultado, hasta que la Unión Europea logró consolidar una concepción revolucionaria bajo los conceptos de interés general y el desplazamiento del Estado hacia un papel distinto al que se había concebido en un inicio para él en lo que respecta a la temática. Este trabajo busca describir brevemente y de manera palmaria, las instituciones
jurídicas que la Unión Europea ha implementado, debido a su nueva concepción de servicio público y las consecuencias respecto al papel del Estado, del sector privado y de conceptos como el interés general en una organización supranacional que se fundamenta en los principios de su Tratado Constitutivo, los cuales desintegran el carácter nacional de los servicios públicos por completo y de manera novedosa.

Abstract
At the very beginning, the public services were only state conceived. A lot of great authors like Dugüit and the Bordeaux School attributed the State, the exclusive possibility of provide or dispose of them, in the way it prefers to reach the social aspirations it has. Nevertheless, this concept had many irregularities and couldn’t keep consistence because of flaws on its conceptual nature and the contraposition with a globalized reality, filled with economic, politics, geographies interests, etc. Many States have searched for a solution to be able to provide public services sustainably and reach all the social purposes, without harming the citizens or leaving them at mercy of the private sector. Between all the States, on a collective or an individual way, the solutions they found seemed to not be the right ones, until de European Union achieved consolidate a revolutionary conception under the concepts of general interest and the relegation of the
State to a different role that the one that was conceived for it at the beginning of this topic. This paper, expects to d|escribe in a short and correct way, the juridical institutions that the European Union has implemented, because of its new public services conception and the consequences it has for the State, the private sector and concepts just as general interest on a supranational organization fundament by the principles of its Constitutive Treaty, that completely destroy the national character of the public services.
